MEMBERS' QUESTIONS
EVEN THOUGH WE NEED TO FOLLOW CERTAIN GUIDELINES, WE WANT ALL HOMEOWNERS TO PARTICIPATE IN OUR MEETINGS. WITH THIS IN MIND, WE HAD CHANGED OUR POLICIES THAT WERE IN PLACE FOR OVER 6 YEARS (Limited time for Homeowner comments/concerns) SO THAT ALL HOMEOWNERS COULD PARTICIPATE THROUGHOUT BOARD MEETINGS (EXCEPT EXECUTIVE SESSIONS), AND GET INVOLVED. WE DID NOT WANT YOU TO ONLY ATTEND MEETINGS WHEN YOU HAD AN ISSUE. WE WANTED YOU TO BE PART OF THE PROCESS OF RUNNING YOUR HOMEOWNERS ASSOCIATION. Unfortunately, the unrestricted open forum and unrestricted comments have limited the Boards ability to conduct association business during meetings.
We are going back to the limited open forum format- 3 minutes (unless you have arranged for additional time). "Homeowner Open Forum" will take place at 5 P.M. and for those that cannot make it at 5 P.M., if you give management advance notice, we will schedule you to speak at 6 P.M. The Board Meets the 3rd week of every month - 5:00 P.M. (except holidays). All Voting Members of The Association are Welcome to Attend. Click here to contact Management for address.
Why we are limited in our responses during Open Forum:
One of the curious aspects of the Open Meeting Act is its limitation on the board's ability to answer questions. As provided for in Civil Code §1363.05(i)(2), the board (or its managing agent or other agent of the board or a member of the staff) may not discuss any item not on the meeting agenda except to:
· briefly respond to statements made or questions; and to
· ask a question for clarification, make a brief announcement, or make a brief report on his or her own activities, whether in response to questions posed by a member of the association or based upon his or her own initiative.
Answering Questions. Unless questions from the audience are harassing in nature or involve confidential information, we will provide brief informational responses during Open Forum. For example, Q: "When are the trees scheduled to be trimmed?" A: "Crews are scheduled to start work next Tuesday at 9:00 a.m." After Open Forum has closed, members have the right to observe the board's conduct of the association's business but they do not have a right to interrupt with questions or comments.
If you have something really important you want discussed, please submit it as part of the agenda at least 5 days prior to each board meeting. You can submit your request to add something to the agenda by contacting management.
