Chateau Park Homeowners Association 
RULES AND REGULATIONS GOVERNING
ROOF REPLACEMENT AND REPAIR

 
 
Chateau Park is a planned unit development, and homeowners are subject to all applicable rules and regulations, including those adopted by the Association’s Board of Directors.  As per section G-13 of the Association Rules and Regulations “no one is permitted on any roof without prior written authorization from the Board of Directors,” and in accordance with the policies herein.
 
Roofs are not part of the Association “common area.” Each homeowner is personally responsible for the maintenance, repair, and/or replacement of all or any part of the “exclusive use” portion(s) of their roof(s).
 
Because roofs are continuous along the length of each multi-unit building, the actions of one homeowner doing repair or replacement work could infringe on the exclusive use rights of another homeowner, and/or compromise the integrity of the roofs of other owners.   These Rules and Regulations are intended to govern the scope and implementation of work done on roofs in order to protect the rights of other homeowners, and to insure that roofs retain a uniform appearance that conforms to the maximum extent possible with the original roof tile and design.
 
 
1.     The original tiles used throughout the complex have a lifetime manufacturers’ guarantee against wear and/or breakage under normal use.  Any defective tile will be replaced by the manufacturer without charge (tiles only, not installation) for the life of the building.  See attached
 
2.     Prior to entering on a roof, homeowners must contact the management company, and request permission to access their exclusive use area of the roof, to detail the reasons, and to describe work that will be done using the Association’s Architectural Approval Request form.  No work can commence prior to obtaining written Board approval and all applicable local permits.
 
3.     As part of the submission to the management company, homeowners must provide the name and address of the roofing company that will do the work, including a copy of their current liability insurance certificate for no less the aggregate sum of $2,000,000, indemnifying and holding Chateau Park Homeowners Association harmless against any and all claims for injury or damage of any kind while on Association property and/or on the exclusive use section of the homeowner’s roof.
 
4.     Authorization from the Board will extend only to access to the homeowner’s “exclusive use” portion of the roof, and may not infringe upon any other portion of the roof.  This includes crossing an adjacent roof for any reason.   For purposes of these rules and regulations, the “exclusive use area” of the roof shall be defined as where each homeowner’s common living space wall with each other homeowner’s common living space wall begins and/or ends. 
 
 
 
5.     If the work involves replacement of tiles, the management company has the manufacturer name and style of the tiles for each building that are authorized for use. No other tile can be used, and enforcement action will be taken against any homeowner who is found to be in violation.

a.     If the supply of original tiles has been exhausted and a partial repair is needed on the front side of the unit, then original tiles from the rear of the unit shall be removed and used, and replaced with the new tiles on the rear.  This is to conform with the policy as set forth at the beginning that the appearance of the unit from the cul-de-sac and street remains as uniform with the entire building as possible.
 
Most roof leaks are the result of tears in the roofing felt that underlies the tiles.  Replacement of an entire roof can be disruptive, costly, and often unnecessary.  Homeowners shall deal only with reputable licensed and bonded roofing companies to determine whether removing roof tiles to do a simple repair of the underlying roofing paper and then replacing the original tiles will solve the problem.
 
6.     In the event of emergency repairs homeowners may proceed to take action on an urgency basis to solve the immediate problem, but only using a licensed, bonded, and insured roofer.  Homeowner shall notify the Association Management as soon as possible thereafter, and get written authorization as per these Rules and Regulation to do any further roof work.

WALK ON, OR MAKE ANY OTHER INCURSION ONTO
A NEIGHBOR’S ROOF FOR ANY REASON,
INCLUDING CLEANING OR REPAIR OF RAIN GUTTERS,
WITHOUT THE EXPRESS WRITTEN AUTHORIZATION OF THAT NEIGHBOR.
